What is Section 504?
Section 504 is a part of the Rehabilitation Act of 1973
- prohibits discrimination based upon disability
- an anti-discrimination, civil rights statute
- requires the needs of students with disabilities to be met as adequately as the needs of the non-disabled are met.

Undertakes process to identify and locate every qualified handicapped person residing in the recipient's jurisdiction who is not receiving a public education
Take appropriate steps to notify handicapped persons and their parents or guardians of the recipient's duty under this subpart.

Possible Recommendations:
- Response to Intervention (RTI)

When the district/staff has knowledge that a student in the RtI process has an impairment, a referral for evaluation should be made.
Evaluations can be conducted simultaneously with the RtI process.
Follow the RtI accommodation plan and document progress to provide when requested.
Make-up of Section 504 CommitteeBe sure your Section 504 Committee is composed of members who have knowledge of: The child - The evaluation data - Placement options If the evaluation data includes medical information, it would be appropriate to include the campus nurse If the evaluation data includes psycho-educational or a psychological/psychiatric evaluation a diagnostician or licensed specialist in school psychology would be an appropriate committee member
A section 504 evaluation is the collection and review of existing data, both quantitative and qualitative.

What About Temporary Impairments?
- A temporary impairment is an impairment that is expected to last six months or less.
- Temporary impairments should be considered for Section 504 on a case-by-case basis considering:
- Do not make any blanket statements that temporary impairments are not covered under Section 504.
