Delibera n. 353 del 6 marzo 2012
5) Ai sensi dell’art.5, comma 2, del DPR 275/99, le singole istituzioni scolastiche hanno la facoltà, all’interno dell’arco temporale determinato dal presente atto, che garantisce almeno 205 giorni di attività didattica, e fatta salva l’inderogabilità dei giorni complessivi da esso previsti, di procedere ad adattamenti del calendario scolastico in relazione alle esigenze specifiche derivanti dal Piano dell’offerta formativa, nel rispetto dell’obbgo di destinare allo svolgimento delle lezioni almeno 200 giorni (art.74, co 3 D.Lgs. 297/94). I giorni eccedenti tale quota fanno parte integrante del calendario scolastico, quale quota destinata ad interventi didattici ed educativi (art.74,co 7/bis D.Lgs.297/94). Restano non adattabili le date di inizio e termine delle lezioni, con le eccezioni di cui ai commi 2, 3 e 4, e le festività nazionali.
