For the purpose of recruitment: Publicness definition: a public company is defined by the common definition, i.e. a company or a subsidiary of a company that is listed in any stock exchange (including OTC).

Recency matters: an expert who ended their consulting relationship 2 years ago poses a different compliance risk than one who ended it last month. The more recent the relationship, the higher the risk of residual access to sensitive information.

Even if a consultant is no longer actively consulting, they may still have access to confidential information. Treat them with the same rigour as a former employee.
