These regulations ban the sale or supply of single-use (disposable) vapes in England, as of 1 June 2025. Single-use vapes (e-cigarettes not intended or able to be refilled or recharged) can no longer be sold, offered, or stocked for sale by businesses. The goal is to reduce the huge environmental harm caused by millions of disposable vapes being littered or thrown away. This ban is also expected to remove brightly packaged disposables from the market, which have been highly popular with underage users, thus indirectly helping discourage youth vaping

Enforcement Powers
Consumer Protection Act 1987: Primarily a product safety law, defining offences for unsafe goods and providing certain powers (e.g. suspension notices to temporarily ban sale of dangerous products). It is mainly about safety offences and specific safety measures; it’s not the general authority for day-to-day inspections in this case. Trade Marks Act 1994: Establishes offences for counterfeit goods and trade mark infringements. It doesn’t itself provide broad inspection powers – Trading Standards rely on general powers (e.g. CRA 2015) to investigate and seize counterfeit items. The Act defines what’s illegal (selling counterfeit goods), but the practical enforcement powers come from elsewhere.
Tobacco and Related Products Regulations 2016: Sets out product standards and offences for tobacco products and e-cigarettes (e.g. packaging warnings, nicotine limits, product notification). These regulations create specific offences and requirements but do not themselves give Trading Standards general powers of entry or seizure. Consumer Rights Act 2015: Under Schedule 5, officers have powers to enter premises, inspect goods/documents, purchase test items, seize products and so on. These powers can be used across many consumer protection laws (the Act lists relevant laws in its schedules). This is the key source of enforcement powers in typical Trading Standards investigations.

Types of enforcer
Domestic Enforcer Enforcement bodies who have a power or a duty to enforce consumer law in the UK. Public Designated Enforcer Person or body which is a public designated enforcer for the purposes of Chapter 3 of Part 3 of the Digital Markets, Competition and Consumers Act 2024 (section 151(1)) Authorised Enforcer UK consumer enforcement bodies who have been designated under CRA Sch 5 para 20(7) as an Authorised Enforcer, in relation to exercising functions under Part 3 of the Digital Markets, Competition and Consumers Act 2024. Unfair Contract Terms Enforcer Persons or bodies who may enforce provisions relating to unfair contract terms (Sch 3 para 8(1):
Notice for Routine Inspections (CRA 2015):
The default rule is that officers must provide at least 2 working days’ written notice before a routine Trading Standards inspection. Exceptions (no notice needed) if:
- There is reasonable suspicion of a breach of the law.
- Giving notice would defeat the purpose of the visit (e.g. risk of evidence being removed).
- There is an immediate risk to public health or safety.
- It’s a market surveillance visit (e.g. under GB RAMS).
- The business consents to waive the notice requirement.
Who / What?
- All Electrical and Electronic Equipment (EEE) placed on the UK market across all sectors, including any vaping devices (single-use or reusable), because they contain batteries and electronics.
- Applies to manufacturers, importers (“producers”), and distributors/retailers who sell EEE (which includes vapes)
Offences:
Retailers commit an offence if they: ❌ Do not offer free WEEE take‑back ❌ Do not run or join an approved take‑back scheme ❌ Do not give customers WEEE information ❌ Do not keep WEEE records

Producers must register annually and, if above threshold (>5 tonnes/year), join a compliance scheme to finance collection & recycling of WEEE. Retailers (distributors) must offer free in-store take-back for old electronics – meaning consumers buying a new vape can return an equivalent old one for free disposal. Retailers often fulfill this by providing collection bins for used vapes to ensure they’re recycled.

Product standards & packaging: All cigarettes and hand-rolling tobacco must have large combined text+graphic health warnings on packs (covering e.g. 65% of the surface). Flavoured cigarettes (like menthol) and certain additives (e.g. vitamins, caffeine) are banned. E-cigarettes and e-liquids have maximum nicotine concentration (20 mg/ml) and limited refill sizes (10 ml for e-liquids; 2 ml tank size). E-liquids must be child-resistant and carry nicotine health warnings. Product notification: Manufacturers/importers must notify the Department of Health/MHRA with detailed information before selling a new tobacco or e-cig product in the UK. Advertising & promotion: Almost all advertising of e-cigarettes in print, broadcast, or online media is banned (except in trade publications) Cross-border sales of tobacco/vapes are controlled via a registration system (sellers shipping to consumers in other countries must be registered).
