Mutual Consent Negotiations (Section 2.01)

When Negotiations Occur:
  • Matters not specifically covered by the Contract but of concern to both parties
  • Subject to negotiations during the period of the Contract

Mutual Consent Negotiations (Section 2.01)

Party Responsibilities:
  • Cooperate in arranging meetings
  • Select representatives for discussions
  • Furnish necessary information
  • Constructively consider attempts to resolve matters

Consultations and Communications (Section 2.02 - Part A)

Regular Meetings Required:
  • LCTA President & Superintendent
    • Meet regularly to discuss matters of mutual interest
  • LCTA President & Director of Labor and Employee Relations
    • Meet regularly to confer on Contract administration matters

Regular Meetings Required:
  • Administrative Leadership & LCTA President
    • Associate superintendents, assistant superintendents, and other appropriate District administrators
    • Meet as necessary to address Contract administration or educational program issues
    • Issues must relate to terms and conditions of employment

Review Contract administration and resolve problems that may arise

Consultations and Communications (Section 2.02 - Part B)

Legislative Coordination (2.02 B):
  • Superintendent, Board, and LCTA agree to coordinate support for legislation
  • Focus: Quality and funding of public education in Leon County and the State
  • Coordination to the extent feasible

Negotiating Authority (Section 2.03)

  • Neither party controls the selection of the other party's negotiating representatives
  • Final Agreement Requirements:
    • Ratification by a majority of the Board
    • Ratification by a majority of bargaining unit employees voting on the Contract

    • Consider proposals
    • Make concessions
    • Execute agreements

  • Philosophy: "Collaborative" Contract Negotiations

    • A. Joint Negotiations Team
      • Comprised of appointed representatives from Board and LCTA
      • Includes Chief Negotiators/Facilitators from both sides

    • B. Open Discussions
      • All issues brought forth by either party as subjects of negotiation
    • C. Recommendations
      • May be provided by committee and work teams
      • Representing both District and LCTA
      • Aid in language development and problem solving

      • Final work product of Joint Negotiations Team
      • Both parties retain original signed copies
  • Recommendation: Superintendent participation in all joint meetings and discussions

  • Written Proposals (2.05):
    • All proposals and counterproposals to amend the Contract
    • Must be reduced to writing
  • Mediation/Fact-Finding Costs (2.06):
    • Shared equally by Board and LCTA
    • Exception: As provided by PERC order

Contract Access and Distribution (2.07):

  • Electronic: Primary access through District and Association websites
  • Printed Copies: Limited number printed at Board expense within 60 days after ratification
  • New Employees: Printed copies provided for new employees and administrative purposes
  • LCTA Distribution Board furnishes 100 copies to LCTA for Association use

Scenario 2: Collaborative Negotiations Begin

The LCTA's team includes the Chief Negotiator and three teacher representatives. During the first session, one Board representative suggests they should be able to choose who the LCTA sends to the table, and one LCTA representative proposes changes to a policy without submitting them in writing first.

Additionally, the contract has just been ratified, and the District needs to determine how to distribute copies to employees and ensure access.
