Certificate of psychophysical aptitudes

Another requirement is to have a certificate of mental and physical fitness. This document certifies that the person applying for a firearms licence is physically and mentally fit to own and use a firearm. This certificate ensures that only those who are fully capable of handling a firearm safely can obtain a licence.

Be of legal age and resident in Spain

These licences are only granted to Spanish nationals or foreigners legally residing in Spain who are over 18 years of age. Exceptionally, minors aged 14 and over may apply for a Special Authorisation for Minors (AEM) to use firearms, provided that it is for hunting or sporting competitions.

Passing theoretical and practical tests

Some firearms licences in Spain (types D, E or AEM) require applicants to pass two proficiency tests before they can be obtained for the first time: one theoretical and one practical. The theoretical exam tests the applicant's knowledge of firearms, their care and maintenance, and the Firearms Regulations. Once the theoretical test has been passed, the practical test is carried out, in which the examiner assesses the applicant's ability to handle and use firearms.

Approved Gun Safes

It is mandatory to store firearms in approved security gun safes, the characteristics of which vary depending on the type of licence and firearm. This ensures that firearms are securely stored and inaccessible to unauthorised persons. The security requirements for these gun safes are detailed in the regulations.

The law on self-defence

Spanish law includes a section for people who want to defend themselves in the event of an attack with a firearm. For it to be considered self-defence, the following conditions must be met: - Defending oneself after the attacker has launched the attack. - Defending oneself in a manner proportional to the attack. The legislation seeks to protect public safety by minimising the presence of weapons in public places and in private hands.

Prohibition due to Physical or Mental Conditions

The law prohibits the possession of weapons by persons who, due to their physical or mental condition, may pose a risk to themselves or others. This includes mental health problems or the use of substances that affect judgement or the ability to drive safely.

Periodical Journal of the Weapon

Licence holders are required to present their weapons periodically (usually every five years) to la Guardia Civil Weapons and Explosives Intervention Unit for inspection. This allows the condition of the weapon, the validity of the licence and compliance with safety conditions to be verified.

Rigorous Documentation

Each weapon must be accompanied by its corresponding Ownership Guide, a document that identifies it and links it to its owner. In addition, specific certificates and authorisations are required for transport or any other circumstance related to the weapon. Rigorous documentation is key to state control.
