Ce sommet a rassemblé des dirigeants, scientifiques et activistes de 179 pays. Plusieurs textes ont été adoptés, à l’instar de la déclaration de Rio, avec 27 principes liés à la durabilité. La Convention-cadre des Nations unies sur le changement climatique, la Convention sur la diversité biologique et que la Convention des Nations unies sur la lutte contre la désertification ont été fondées lors de ce sommet. Elles donnent lieu à l’organisation de conférences des parties (COP) sur ces sujets.
Directive Européenne sur le Devoir de Vigilance (CS3D)
Cette directive, appelée CSDDD ou CS3D pour corporate sustainability due diligence directive, concerne les entreprises européennes de plus de 1 000 salariés et réalisant un chiffre d’affaires mondial supérieur à 450 millions d’euros. Le texte exige qu’elles préviennent, réduisent ou mettent fin aux effets négatifs de leur activité sur les droits humains et l’environnement sur l’ensemble de leur chaîne de valeur.

Depuis 1976, les pays membres de l’OCDE et d’autres États - 51 à ce jour - adhèrent à ces principes. Il s'agit de recommandations que les gouvernements adressent aux entreprises multinationales. Elles visent à encourager la contribution des entreprises au développement économique, à la protection de l’environnement et à la réponse aux enjeux sociaux, ainsi qu’à les inciter à limiter leurs impacts négatifs sur les individus, la planète et la société. Ils ont été mis à jour à plusieurs reprises depuis.
Directive Européenne sur les Rapports de Durabilité (CSRD)
La directive européenne CSRD, pour corporate sustainability reporting directive, concerne les entreprises de plus de 250 salariés, de plus de 50 millions d’euros de chiffre d’affaires ou ayant un total de bilan supérieur à 25 millions d’euros. À partir de 2029, toutes doivent rendre compte dans un rapport des effets d’enjeux sociaux, environnementaux et de gouvernance sur leur activité ainsi que de leur impact sur ces enjeux. Elles appliquent ainsi le principe dit de « double matérialité ».

Le rapport Meadows
Le rapport Meadows, publié en 1972 sous le titre The Limits to Growth (Les limites à la croissance), est une étude commandée par le Club de Rome et réalisée par une équipe de chercheurs du MIT dirigée par Donella Meadows.Ce rapport s’appuie sur des modèles informatiques pour analyser l’évolution à long terme de la planète en prenant en compte plusieurs variables majeures : la croissance démographique, la production industrielle, la consommation des ressources naturelles, la pollution et la production alimentaire. La conclusion centrale du rapport est que la croissance économique et démographique infinie est impossible dans un monde aux ressources limitées.Le rapport montre que si les modes de production et de consommation ne changent pas, les sociétés humaines s’exposent à des crises majeures : épuisement des ressources, dégradation de l’environnement, effondrement économique et tensions sociales.
Apparition du concept de la RSE
L’économiste américain Howard Bowen utilise cette notion pour la première fois dans l’ouvrage The Social Responsabilities of the Businessman.
Loi sur le devoir de vigilance
Avec cette loi, les entreprises françaises employant au moins 5 000 salariés doivent établir et mettre en œuvre un plan de vigilance relatif à l’activité de la société et de l’ensemble des filiales qu’elle contrôle, pour prévenir les atteintes graves aux droits humains, aux libertés fondamentales, à la santé et sécurité des personnes et à l’environnement résultant de leur activité, de celles de leurs filiales et de leurs sous-traitants et fournisseurs.
Loi PACTE
Il s’agit de la loi relative à la croissance et la transformation des entreprises. Elle modifie le Code civil et le Code du commerce, en affirmant la nécessité pour l’ensemble des entreprises de prendre en considération les « enjeux sociaux et environnementaux de [leur] activité ». Elle modifie aussi le Code civil pour reconnaître la possibilité pour une entreprise de se doter d'une raison d'être inscrite dans ses statuts, c'est-à-dire des « principes dont elle se dote ». Elle crée par ailleurs la qualité juridique d’entreprise à mission dont une société peut faire état si ses statuts précisent sa raison d’être, un ou plusieurs objectifs sociaux et environnementaux, ainsi que les modalités de suivi et d’exécution de ces objectifs.

Elles visent à encourager la contribution des entreprises au développement économique, à la protection de l’environnement et à la réponse aux enjeux sociaux, ainsi qu’à les inciter à limiter leurs impacts négatifs sur les individus, la planète et la société. Ils ont été mis à jour à plusieurs reprises depuis.
Directive Européenne sur les Rapports de Durabilité (CSRD)
La directive européenne CSRD, pour corporate sustainability reporting directive, concerne les entreprises de plus de 250 salariés, de plus de 50 millions d’euros de chiffre d’affaires ou ayant un total de bilan supérieur à 25 millions d’euros. À partir de 2029, toutes doivent rendre compte dans un rapport des effets d’enjeux sociaux, environnementaux et de gouvernance sur leur activité ainsi que de leur impact sur ces enjeux. Elles appliquent ainsi le principe dit de « double matérialité ».

Le rapport Meadows
Le rapport Meadows, publié en 1972 sous le titre The Limits to Growth (Les limites à la croissance), est une étude commandée par le Club de Rome et réalisée par une équipe de chercheurs du MIT dirigée par Donella Meadows.Ce rapport s’appuie sur des modèles informatiques pour analyser l’évolution à long terme de la planète en prenant en compte plusieurs variables majeures : la croissance démographique, la production industrielle, la consommation des ressources naturelles, la pollution et la production alimentaire. La conclusion centrale du rapport est que la croissance économique et démographique infinie est impossible dans un monde aux ressources limitées.Le rapport montre que si les modes de production et de consommation ne changent pas, les sociétés humaines s’exposent à des crises majeures : épuisement des ressources, dégradation de l’environnement, effondrement économique et tensions sociales.

Loi sur le devoir de vigilance
Avec cette loi, les entreprises françaises employant au moins 5 000 salariés doivent établir et mettre en œuvre un plan de vigilance relatif à l’activité de la société et de l’ensemble des filiales qu’elle contrôle, pour prévenir les atteintes graves aux droits humains, aux libertés fondamentales, à la santé et sécurité des personnes et à l’environnement résultant de leur activité, de celles de leurs filiales et de leurs sous-traitants et fournisseurs.
Loi PACTE
Il s’agit de la loi relative à la croissance et la transformation des entreprises. Elle modifie le Code civil et le Code du commerce, en affirmant la nécessité pour l’ensemble des entreprises de prendre en considération les « enjeux sociaux et environnementaux de [leur] activité ». Elle modifie aussi le Code civil pour reconnaître la possibilité pour une entreprise de se doter d'une raison d'être inscrite dans ses statuts, c'est-à-dire des « principes dont elle se dote ». Elle crée par ailleurs la qualité juridique d’entreprise à mission dont une société peut faire état si ses statuts précisent sa raison d’être, un ou plusieurs objectifs sociaux et environnementaux, ainsi que les modalités de suivi et d’exécution de ces objectifs.
