The background of the issue

Under the 14th Amendment (1868), anyone born on U.S. soil automatically becomes a U.S. citizen even if their parents are not citizens or are in the country illegally.This is called birthright citizenship.

How This Amendment Solves the Problem

“This punishes innocent children.”

Children could still apply for citizenship through a fair, legal process.

“It’s unconstitutional.”

The amendment itself would redefine the Constitution, making it legal and clear.

A child born in the United States will be a U.S. citizen only if at least one parent is a citizen or a legal permanent resident at the time of the child’s birth.

Children born in the U.S. to parents who are not citizens or legal residents will not automatically become citizens. However, they can apply for citizenship once they have lived in the country for at least five years and can prove legal residence.

Congress will have the authority to create and enforce laws to carry out this amendment.
