TRANSFER RIGHTS:Parents control education records until the student turns 18 or enters college—then the student becomes an “eligible student” and gains those rights
DISCLOUSURE WITHOUT CONSENT:Schools may share records with parents if the student is a tax-dependent
CORE RIGHTS:
- Review education records
- Request corrections
- Control disclosure of personal information
WHO MUST FOLLOW FERPA?
- Public schools and agencies receiving federal funds
- Charter schools (considered public)
- Juvenile justice education programs
WHO IS EXEMPT?
- Most private/parochial schools (unless federally funded)
- Private schools with McKay Scholarships (state-funded only)

responsibilites toward students
- Must respect students’ legal rights and avoid intentional violations
- Must not block parental involvement in critical health decisions unless there's a risk of abuse or neglect
- Must not harass or discriminate based on race, religion, sex, age, origin, beliefs, disability, sexual orientation, or family background
- Must not promote discriminatory concepts listed in Florida law
- Must not exploit student relationships for personal gain
- Must keep student information confidential unless legally required or professionally necessary
- Must follow laws regarding restroom and pronoun use in schools
OBLIGATIONS TO THE PUBLIC
- Must clearly separate personal views from institutional positions
- Must not misrepresent facts about educational matters
- Must not use school privileges for personal benefit
- Must not accept or offer gifts that could influence or gain unfair advantage

FAIR ASSESSMENT
Schools must evaluate your child before deciding on placement or services, and again before any major change
Assessments must be valid, properly administered, and appropriately selected under Section 504 rules
Schools must consider multiple sources—tests, teacher input, health records, and parent observations
Students must be reevaluated periodically (usually every 3 years), and parents must be notified before any action
A 504 committee must make placement decisions, aiming to include disabled students with their peers
