El 9 de febrero de 2023, el Tribunal Constitucional declaró constitucional la Ley Orgánica 2/2010 y resolvió el recurso que el Partido Popular había presentado trece años antes, decidiendo con mayoría a favor y debatiendo la ponencia del magistrado que, aunque validaba la ley de plazos, consideraba inconstitucional el artículo sobre la información a la gestante.

El Pp confirmó la retirada de el anteproyecto de ley por no haber encontrado consenso suficiente y por dicha razón el que fuera Ministro de Justicia dimitió y abandono la política.
2015
El PP presentó un proyecto de reforma para impedir que los menores entre 16- 18 años abortaran sin el consentimiento expreso de sus padres.

En febrero de 2023 se aprobó la Ley Orgánica 1/2023, que modificó la anterior y eliminó la obligación del permiso paterno para las jóvenes, abordó la salud menstrual, suprimió los tres días de reflexión y estableció que se crearan registros de objetores de conciencia para que las intervenciones se realizaran mayoritariamente en la sanidad pública.
