Permanent population.

What is Permanent Population?

When we say Permanent Population, when talking about the state, we are referring to the people that is living inside the territory of the State. The population can be small, like the country of Nauru, or it can be gigantic like the case of India or China.

Capacity to Enter into Relations with Other States

Capacity to Enter into Relations with Other States

It is understood as the capacity to act independently at the international level.Without the recognition of another State, it is difficult to use this capacity.

Additional Elements of Powers and Authority

Territory and Boundaries: Territory is where the authority acts and boundaries is the limit of the territory.

Sovereignty: It is the independece of the State from other influences.

Jurisdiction: It is the power to legislate and the power to enforce the law inside the territory

Recognition: Is the faculty that others states give to another state in order to act internationally.

“Sovereignty in the relations between States signifies independence. Independence in regard to a portion of the globe is the right to exercise therein, to the exclusion of any other State, the functions of a State.”

— Permanent Court of Arbitration, Island of Palmas Case (1928)

Importance of the Elements of the State

The Elements of the State are really important when we talk about international law and international relations between the States, because these elements create a way to identify a real State, or a valid State.

How do you think that those elements should change in order to have a better government in the future?

  • I do believe that the sovereignty of the State is really important, however, everything has to be with some restrictions, i believe that the United Nations have the obligation to intervene in the matters of a State if the State is not protecting the people.
  • A perfect example is the Rwanda genocide in 1994, when the United Nations didn´t intervene and alot of people died.
  • Another example is the situation of Venezuela or Cuba, were the government is killing the population with the power that it has.
