In this presentation we will see all the elements of a state, and we will explain them one by one in a simple way. .

Introduction to the Elements of the State

Definition : A State is a sovereign entity recognized under international law, composed of four essential elements according to the Montevideo Convention of 1933. These are 4 elements: a permanent population, a defined territory, a government, and a capacity to enter into relations. These elements define what makes a state, like France or the United States or even Mexico

Permanent Population

For example Israel in 1948 despite borders which were disputed at the time remained a state, as well as Somalia which remained a state despite tensions and instability

'A community that lives in a stable and permanent way on the territory, without any particular need for a minimum number of inhabitants (e.g. Nauru, 9,300 inhabitants)

Without the population, there would be no state, because it is the population that gives life to politics.

Defined Territory

What is a defined territory ? It is a clear geographic space, which doest need any border. We can take Israel again like an exemple, in 1948 without any clear border, but it was a defined territory. The term terra nullius refers to territories that are not claimed by any state; currently the only state considered to be so is Antarctica. The term uti possidetis refers to a concept that means "as you possess by right." It is a principle of international law according to which the borders of newly independent states or states resulting from the dissolution of a state remain as they were before the process of change Territory is space where State, exercises its supreme authority.

Governement

The governement is a organized political structure , which exercices a control on the territory and population. The form doesnt matter (monarchy or democracy). The governement ensures, order and services, without this the State cant work.

Ability to Build Relationships

States have to be independant, to be able to create international relation through the world. Thanks to this, they be recognize by other countries or States. For exemple Southern Rhodesia, (1965-1979) was not a State because, it was recognize. Monaco, delegates its defense to France but this State is nevertheless recognized. This allows, juridical egality between States.

Sovereignty

There are two types of sovereignty: internal (dominium or imperium) and external (independence and equality with other states). All the States are equal at the ONU, but some countries have the right of veto, that creates disparity. Sovereignty, protects State, external interference while respecting international law.

Importance of the Elements of the State...

These elements ensure stability, international recognition, and the functioning of a state. They prevent chaos (e.g., self-determination to avoid colonial domination). They ensure peace, protect humans rights, enable economic and cultural development. Without them, a State cant exist legally, like in the dissolution of Yugoslavia.

Changes for Better Government in the Future

Governement should be more transparent for a better efficacity. More sovereignty shared in nearby regions like the EU to improve global cooperation.

I think, the founding elements should change and become more inclusive and sustainable. For example, strengthening education and equality. And responding to current challenges such as climate change, by adapting the territories that face these changes.

Diplomacy more focused on climate and human rights These changes, would promote fairer governance, resilient in the face of global crises such as climate change or pandemics.
