Rodrigo Roa Duterte was sworn into office on June 30, 2016 as the 16th President of the Philippines. Soon after taking his oath, he launched his controversial war on drugs, which aimed to eradicate the drug problem in the Philippines.

Several months after the war on drug campaign was launched, human rights groups noted an increase in alleged extrajudicial killings in the country. Government data showed over 6,000 drug-related deaths.

The International Criminal Court (ICC) receives a 77-page complaint against Duterte from lawyer Jude Josue Sabio, legal counsel of self-confessed hitman Edgar Matobato, a member of Davao Death Squad (DDS).

The complaint accused Duterte of crimes against humanity. It contained evidence of his alleged involvement in extrajudicial killings of suspected drug dealers and other crime suspects.

They said their 45-page communication submitted before the Office of the Prosecutor of ICC "affirmed" and supplemented the communication earlier filed by lawyer Jude Sabio.

The investigation covered the period when Duterte was elected as Davao City mayor, from 2011 to 2016, and as President from 2016 to 2019.

Senator Antonio Trillanes IV and Magdalo Representative Gary Alejano filed a supplemental complaint with the ICC, providing further evidence that link Duterte to extrajudicial killings.

The ICC opened a preliminary examination into allegations of crimes against humanity linked to Duterte’s drug war.

Human rights groups and families of some of the war on drugs victims filed a complaint in the ICC, detailing more abuses committed during the drug war.

The new complainants sought Duterte's arrest for the deaths of thousands of people killed amid his brutal anti-narcotics drive. They stressed that Duterte's inhumane acts caused "great suffering to the victims and their families."

The ICC, however, maintained jurisdiction over crimes committed when the country was still a member state -- from November 1, 2011, to March 16, 2019.

A portion of Sabio's letter to ICC prosecutor Fatou Bensouda stated that he asked the ICC to erase his communication from the record.

The Philippines’ withdrawal from the ICC took effect on March 17, 2019.

Jude Josue Sabio withdrew the complaint he filed at the ICC, saying it was all “propaganda.” He said he was just influenced by former senators Antonio Trillanes and Leila de Lima.

Three days after, or on March 17, the Philippine government formally notified the United Nations (UN) of its intention to withdraw from the ICC.

Duterte announced the Philippines’ withdrawal from the Rome Statute, which established the ICC, on March 14, 2018.

ICC Prosecutor Fatou Bensouda requested on May 24, 2021 authorization from the Pre-Trial Chamber to initiate an investigation on crimes allegedly committed from November 1, 2011 to March 16, 2019.

She said that following a thorough preliminary examination process, information indicates that members of the Philippine police and others have unlawfully killed thousands of civilians during that time.

The ICC Prosecution’s request was made public on June 14, 2021.

The Chamber found that there is a reasonable basis to proceed with an investigation, noting that specific legal element of the crime against humanity of murder has been met.

Ferdinand Marcos Jr. was elected as the 17th president of the Philippines on May 9, 2022.

Marcos took his oath of office at the National Museum of Fine Arts in Manila Thursday, June 30, 2022.

ICC Prosecutor Karim Khan asked the Pre-Trial Chamber to authorize the resumption of the investigation on Duterte’s drug war.

Marcos said the Philippines' justice system is functioning and the ICC is a "very different kind of a court."

The Chamber said it was not satisfied that the Philippines is undertaking relevant investigations, especially on the deaths related to the drug war that would warrant a deferral of its investigations.

President Marcos Jr. said he would not cooperate with the ICC’s investigation, saying the country is a sovereign nation.

Marcos called the International Criminal Court’s ongoing probe into the Duterte drug war as a “threat to our sovereignty.”

Solicitor General Menardo Guevarra said the Philippines is not legally and morally bound to cooperate with the ICC, stressing that the impending probe is an indictment against the country’s entire legal and judicial system.

Three out of five ICC judges rejected the appeal of the Philippines where it argued that the ICC cannot exercise jurisdiction over the Philippine situation.

The Philippine Government, through the Office of the Solicitor General (OSG), sought the reversal of the ICC’s decision to resume the investigation.

He said he does not recognize the jurisdiction of ICC over the Philippines.

Trillanes said the warrants of the ICC are expected to be issued in “batches,” wherein former President Duterte is the subject of the first batch, while the following batches will be for the other officials linked to the drug war.

Duterte urged the ICC to "hurry up" with its investigation. He earlier said that he does not recognize the ICC.

On the same day, Duterte was flown to The Hague, Netherlands to face charges of crimes against humanity at the International Criminal Court.

Upon his arrival from Hong Kong, former Ptresident Duterte was arrested at the Ninoy Aquino International Airport (NAIA) Terminal 3.
