• Introdotta dalla legge n. 40/2001.
• Per madri con figli minori di 10 anni quando non applicabile la detenzione domiciliare standard.
• Richiede espiazione di almeno 1/3 della pena (15 anni per ergastolo) e assenza di rischio di recidiva.
• Applicabile anche ai padri in assenza della madre.
• Supervisione da parte del servizio sociale.
• Revocata in caso di violazioni gravi.

• Alternativa alla detenzione per reati meno gravi.

• Obbligo di seguire percorsi educativi e sociali.

Caratteristiche del sistema penale minorile

• Basato sul principio della rieducazione e reinserimento sociale.

• Differente dal sistema penale per adulti.

• Competenza del Tribunale per i Minorenni.

• Priorità a misure educative rispetto alla detenzione.

• Per pene fino a 4 anni (3 anni se recidiva reiterata).
• Simile agli arresti domiciliari ma senza finalità cautelari.
• Beneficiari:

Donne incinte o madri di figli <10 anni.Padri con figli <10 anni se la madre è deceduta.Persone con gravi condizioni di salute.Over 60 inabili o minori di 21 anni con esigenze particolari.Accessibile anche per pene fino a 2 anni in alternativa all'affidamento in prova.Circa 4.932 detenuti in detenzione domiciliare al 30/06/2009.

• Concesso per pene fino a 3 anni.
• Osservazione della personalità per almeno un mese.
• Esteso ai malati di AIDS.
• Dal 1998, possibile concessione senza osservazione in istituto.
• Se rispettati gli obblighi, la pena si estingue.
• Circa 5.908 condannati in affidamento al 30/06/2009

• Esclusione per reati gravi (terrorismo, mafia, tratta di persone, violenza sessuale di gruppo, sequestro di persona a scopo di estorsione, droga, contrabbando, ecc.).
• Benefici solo per detenuti che collaborano con la giustizia.
• Comma 3-bis: negazione dei benefici se esistono collegamenti attuali con la criminalità organizzata.
