Explaining the potential legal and school punishments for students who make threats to schools
Shelter in place → sweep campus for threats → students sent home
California Penal Code Section 422 - Misdemeanor: Up to one year in county jail.Felony: 16 months, two years, or three years in state prison.
California Education Code Section 48900.7 - Student may be suspended/expelled if “pupil has made terroristic threats.”
Terroristic Threat: A person who "willfully threatens to commit a crime that results in death, bodily injury, or property damage excess of $1000"
California Welfare and Institutions Code Section 781 - Juvenile Records are not automatically sealed; sealing of records determined by judges panel.
Suspension and expulsion goes on permanent school records for college admissions. Juveniles legally aren't considered criminals but future employers may access juvenile records.
