WHAT IS WANTED

This article aims to account for the status of mental health as a fundamental right, its main legal positions and the reinforced jurisdictional guarantees it has. To do this, the constitutions of many Latin American countries are taken as a reference. A bibliographic research was carried out that consisted of the compilation of information, creation of files, systematization of the information and elaboration of conclusions. After carrying it out, it has been possible to affirm that mental health is indeed a fundamental right. He can be assigned legal positions of defense and benefits, and has guarantees such as amparo and corrective habeas corpus. Basically, it has been concluded that its fundamental nature is based on its recognition in constitutional texts and its link with the satisfaction of the basic needs of the person. CHALLENGE Talking about mental health has become urgent, especially after the COVID-19 pandemic. The World Health Organization reports a 25% increase in cases of anxiety and depression worldwide. This situation shows the need to build public policies that prioritize preventive care and not just the reactive response.
