FAQs

Can Interviews be conducted via different media - types of videos? +

Is it legal to record the interview? +

Can there be a scribe/can the interview be recorded? +

Interviews should be as consistent as possible for that stage of the process. The first round of interviews, for example, should not be a phone interview for one candidate and in-person for another candidate. If a virtual meeting format will be used, be sure to confirm the format with the candidate to be sure they can access the type of meeting (Zoom vs. Microsoft Teams, for example). Also, be consistent with expectations of audio only phone interviews, for example vs. audio plus video for the same round of interviews with different candidates. In all things, be as consistent as possible.

Texas is considered a “one-party consent” state. This means that unless at least one of the parties to a conversation consents, both Texas and federal wiretapping laws make it a crime to record an audio conversation, either in person or over the phone, if the parties have a “reasonable expectation of privacy.” In other words, because the person in the room facilitating the recording consents to the recording, the interview may be recorded without the candidate’s knowledge or permission. However, as a matter of courtesy, we recommend informing the candidate that the interview will be recorded as a means of capturing their responses and documenting the interview for the recruiting file.

Yes, there can be one scribe on the interview team/panel that records all candidate answers. The interview can be recorded if necessary to transcribe the interviewee’s responses to questions asked.
