Energy Commission is a company owned by the government, mandated by law , Act, 1997 (Act 541) to regulate and manage the development and utilization of energy resources in Ghana, specifically in electricity , renewable energy and natural gas.

Before any company or entity can operate as a generator, transmitter, or distributor, importer, exporter, retailer or broker of electricity, that entity must obtain the relevant licences as required by the Energy Commission Act 541.

LICENSING

A partnership registered under the incorporated private partnership Act, 1962 (Act 152)

A corporate body registered under the company’s Act, 1963 (Act 179)

A citizen

LICENCE QUALIFICATION AND CONDITIONS

authorizes the licensee to procure, construct and operate an electricity facility to be connected to the national grid (transmission network) to produce electricity for sale to Distribution companies and bulk customers directly or through Electricity Brokers. Up to 20 years

Grid-Connected Generation License

will authorize the license to procure electricity from whole sale supplies to export outside any country. Up to 5 years

Electricity Export License

authorizes the licensee to procure, construct and operate an electricity facility to be connected to a distribution network to produce electricity for sale to the Distribution company and bulk customers directly or through Electricity Brokers. Up to 20 years

Embedded Generation License

TYPES OF LICENCES AND DURATION

Shall authorize a licensed wholesale supplier to import electricity into any country. Up to 5 years

Electricity Import License

Licensed to operate a distribution network and distribute electricity without discrimination to consumers within a specific area. Up to 20 years

Electricity Distribution License

will authorize the licensee to procure electricity from wholesale suppliers for sale to Distribution Companies and Bulk Customers. Up to 20years

Electricity Brokerage License

approve the licensee to oversee and manage the national interconnected network's operation for the transmission of power throughout Ghana and also open access for transmission of electricity within ECOWAS without discrimination. Up to 25 years

Electricity Transmission Supply

will authorize the licensee to procure electricity from wholesale suppliers and sell to consumers without discrimination in the concession designated in their license. Up to 20 years

Electricity Sale (Retail) License

For bulk power purchases, this permits any electricity consumer with a maximum demand for 3 consecutive months or a minimum annual energy consumption of 6 million kWh to negotiate with a wholesale electricity supplier. Up to 60 months or 5 years.

Bulk Customer Permit

permit is obtained in order to begin construction of an electricity infrastructure. up to 24months

Construction Permit

permit is issued to allow a company situate an electricity infrastructure at a particular location after the site has been evaluated by the Siting Committee up to 24months

Regulations aim to establish performance guidelines for electricity supply and distribution, ensuring safety criteria, reliability, and cost- effectiveness

• Review comments with Stakeholders and incorporate comments.
• Submit to the technical committee to review the documents and incorporate comments
• Submit to the Board for review
• Submit to AG and Ministry of Justice, they also review and submit their comments
• AG and Commission engage in a meeting to discuss
• AG forwards it to parliament for pre-laying and goes to the floor of parliament then turns it into a law.

• Find out if the Ministry has policies on the regulation
• Materials needed (research other countries whether they have similar laws/ policies)
• After compiling data, you start drafting
• Organize in-house review meeting (invite legal, inspectorate, and other departments the law may concern)
• Incorporate comments into the documents you have drafted (comments are from inhouse review meeting)
• Organize a stakeholder meeting which includes everyone affected by the law
