Elements
01
" a community which consists of a territory and a population subject to an organized political authority.”
The state as a person of international law should posses the following qualifications
- Permanent population
- A defined territory
- Government
- Capacity to enter into relations with other states
Permanent population
02
Without population, a State has nothing to rule
02. permanent population
This is a very important element of the State because the population is the human support of the political organization of a State
Government
03
06. METODOLOGÍA
Government
The organization that structures and administrates a State, it can adapt different forms and it is always invested with Sovereignity
Sovereignity
The capacity of a State to make laws and execute them with authority, it also implies indpendence from other countries
A defined territory
04
Territory
The geographical space where the State is lcoated, there is not a required size for a State to be considered such, just as long as it is delimited and recognized by other States
- A State may acquire more territory by:
- Occupation
- Acquired prescription
- Cesion
- Accretion and avulsion
- Conquest and subjugation
“the space within which the State exercises its supreme authority”:
capacity to enter relations with other states
05
Manifestation of the elements
In the lecture this one was listed as an element, but I consider it more like a manifestation of those, a State with well-founded elements, naturally will be recognized and will have the capacity to make relations with other States
