A local drone enthusiast has sent you this image of tree planting on a scheduled monument. You have confirmed that it is on the scheduled monument but no scheduled monument consent has been granted for the planting. The monument is a multi-period pre-historic cropmark site.

You have now sourced some additional information including looking at available aerial photographs and have been able to get an accurate mapping of the extent of planting (between purple line and road).
The scheduled area is outlined in red. The field has been subject to cultivation to a depth of 25cm.
Planting has been done by hand with two-year-old whips and tree tubes put over with a bamboo cane to secure. A new fence separates the planted area from the rest of the field.

The response would be a HE Community Resolution. If they admit an offence has occurred then a HE Conditional Caution route is achievable with a condition being the removal of the trees. If the conditional caution isn’t accepted then prosecution possible, but would need to consider public interest and other routes for reversal.If the owners did not engage and did not support the removal, you could go through the Forestry Commission as the planting may meet the criteria for Environmental Impact Assessments (Forestry) Regulations.
