Employment ban

Maternity protection

What is the difference?

Employment ban or "Beschäftigungsverbot"

An employment ban imposed by the employer (in German Betriebliches Beschäftigungsverbot) depends on the workplace and its conditions and is issued by the employer.

betriebliches Beschä ftigungsverbot
betrieblisches Beschäftigungsverbot
ärtzliches Beschäftigungsverbot
An employment ban can be imposed by a doctor if they have determined any health risk that could affect the pregnancy. This is called ärtzliches Beschäftigungsverbot.

Salary

Maternity protection

What is the difference?

Mutterschutzlohn vs. Mutterschaftsgeld

Mutterschutzlohn

Your employer pays the Mutterschutzlohn (maternity pay) if you are not allowed to work due to an employment ban.

The Mutterschutzlohn corresponds to the average gross salary of the last 3 months before the pregnancy.

Mutterschaftsgeld

During maternity leave the health insurance pays the Mutterschaftsgeld (maternity benefits) for people with statutory coverage.

If your average net pay per day is more than 13 euros, your employer pays for an additional contribution, called Arbeitgeberzuschuss.

Protection against dismissal

Maternity protection

Inform your employer

It is recommended that you inform your employer as soon as you become aware of your pregnancy. However, there is no legal obligation to inform your employer before a specific deadline (§ 15 Maternity Protection Act).

Maternity protection

Health protection at work

Pregnant women are not allowed to perform heavy physical work, lift weights of more than 5 kg on a regular basis, work at night (8 p.m. to 6 a.m.), or work in areas where there is: dust, gas, fumes, heat; or extreme cold, humidity or noise.

Maternity protection

Protection against dismissal

You are protected from dismissal only if your employer knows you are pregnant, have given birth or have had a miscarriage. If your employer dismisses you before you inform them, you can still do so within 2 weeks from receiving notice and you will then be protected against dismissal.
