START
The Fifth Amendment
SECTION 1
"No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation."
The Meaning
SECTION 2
The 5th Amendment of the United States Constitution grants citizens the right to avoid self-incrimination in court. This means that individuals can refuse to answer questions that might make them appear guilty, by invoking their 5th Amendment right. The government is then required to provide evidence or testimony from a witness to prove the crime, and cannot force individuals to testify against themselves. Additionally, individuals cannot be tried for the same crime more than once, and private property can only be used by the public with fair compensation paid to the owner.
Background Information Pt.1
SECTION 3
- The Fifth Amendment was passed to ensure that citizens are accused of a crime justly.
- After the Revolutionary War, the United States was trying to establish a strong government. However, the Articles of Confederation were too weak to provide satisfactory rights to the people. As a result, the 5th Amendment was passed to provide better rights to the people than the Articles of Confederation did.
Background Information Pt.2
SECTION 4
- The Fifth Amendment, which is part of the Bill of Rights, was ratified on December 15, 1791.
- The events that led up to the passage were people being concerned about protecting their rights and preventing self-incrimination. People wanted to ensure proper due process which is a legal obligation that makes sure the government operates the law using fair procedures

Miranda vs Arizona Pt.2
Section 6
Miranda vs Arizona is one of the most famous examples of the 5th Amendment. In 1963, Ernesto Miranda a Mexican immigrant, was charged with stealing eight dollars from a bank in Arizona. At the time of his arrest, he was a suspect in an eighteen-year-old rape and kidnapping. After hours of interrogation, Miranda signed a confession to the rape and kidnapping. However, Miranda was never read his rights and was never offered an attorney.
Miranda vs Arizona Pt.3
Section 7
Later in court, Miranda was finally given an attorney who tried to object to the confession since Miranda hadn't signed it voluntarily because he wasn't read his rights. Unfortunately, the lawyer's objection was overruled and Mirnada was sentenced to 20-30 years in jail. Miranda then went to the Arizona Supreme Court to get an appeal but the Arizona Supreme Court upheld the conviction. Miranda didn't want to give up so he appealed to the United States Supreme Court. Luckily, Miranda's conviction was overturned, showing the importance of the 5th Amendment.
Impact
Section 8
As you can see The 5th Amendment has had a significant impact on many trials as it protects citizens from unfair trials and self-incrimination. Without this protection, many people might face wrongful charges for crimes they didn't commit, while some guilty people might not receive a fair trial. We tend to take the 5th Amendment for granted these days, but we should be more grateful and aware of our rights, considering not all law enforcement officials follow the rules.
"The Fifth Amendment is an old friend and a good friend, one of the great landmarks in men's struggle to be free of tyranny, to be decent and civilized.
William O.Douglas
