Release to an ORR-approved Sponsor

The sponsor is responsible for the child's care and needs in the United States, including ensuring the UC complies with their immigration court proceedings. NOTE: Being apporoved as a sponsor does NOT confer legal guardianship.

Transfer to ORR Care

Office of Refugee Resettlement (ORR) staff work to identify and vet a sponsor. Some cases, prior to final release decision, are referred for a home study.

Apprehension by DHS

Apprehension could take place at the border by Customs and Border Patrol (CBP) or internally by Immigration and Customs Enforcement (ICE). The Department of Homeland Security (DHS) will issue a Notice to Appear (NTA) to initiate the removal proceedings for the minor. DHS will file the NTA with the Immigration Court.

UC Migrates

A child meets the definiton of a UC if they:

  • Are under 18
  • Have no legal immigration status
  • Have no parent or legal guardian available to provide care and custody
