Law 104/1992, is the main frame for all disability issues: it guarantees people with disabilities and their families the ownership of specific rights; provides assistance; states the full integration and the adoption of prevention measures and functional recovery; ensures social, economic and legal protection. Moreover, prescribes to remove any barrier (architectural and sensorial) and to introduce appropriate aids and tools to support pupils with disabilities in education and training.

Decree 66 puts the focus on the school environment and enhances individual education plans for pupils, aiming to identify barriers and facilitators in school life. Parents submit information about their children so schools can provide all necessary support. In addition, families are eligible for other help measures, including financial support, according to the national health plan.

Japan - Tokyo

Decree no. 182 of 29 December 2020 defines support measures for pupils with disabilities. It established a new National Individualised Education Plan (IEP) that follows the bio-psycho-social approach, which moves away from the idea that disability equals disease. The core principle is the educational co‑responsibility of the whole learning community and it takes into consideration the environmental and personal factors. It focuses on the awareness that each of us can be a facilitator or obstacle to someone's life.

Law 170/2010 recognises dyslexia, dysgraphia, dysorthographia and dyscalculia as specific learning disorders. This Law – which states that pupils with learning disorders do not need special teachers, but rather a new way of teaching, depending on their way of learning – promotes a change in perspective. The aim is to shift the focus from a clinical to a pedagogical view, by empowering all subjects involved in the educational process.

Law 107/2015 (in Italian also called " LA BUONA SCUOLA") affirms the school’s central role in society. It aims to raise all learners’ levels of education and skills, based on individual learning times and styles. This will counteract inequalities, prevent school drop-out and create open schools as permanent labs for research, experimentation, educational innovation, participation and education for active citizenship. It will also guarantee the lifelong right to study, equal opportunities and achievement.

ART. 3According to the Constitution of the Italian Republic: “all citizens have equal social dignity and are equal before the law, without distinction of sex, race, language, religion, political opinion, personal and social conditions. It is the duty of the Republic to remove those obstacles of an economic or social nature which constrain the freedom and equality of citizens, thereby impeding the full development of the human person”. ART 34 Schools are open to everyone. On those pillars is based our educational system.

This law abolished separated classes for disabled children and implemented 'procedures to integrate handicapped pupils by providing Special Education teachers', both in primary and middle schools. Disabled children were coming out from their hidden places.

Who are Special Education Teachers?

Special education teachers support students with cognitive disability or emotional or physical impairments certified by the law 104/1992 and work directly with the students. They may adapt teaching methods and materials to accommodate their students' learning styles and abilities.

The Ministerial Directive 27 December 2012, on BES (SEN), created an “umbrella”, to cover all kinds of difficulties at school: disabilities, SLDs (specific learning disability), SDDs (specific developmental disorder), socioeconomic, cultural or linguistic disadvantage or pupils that can be anyhow in need of special care. This, in order to ensure more inclusive practices in classrooms through individualized and personalized educational plans.

Helen Adams Keller (1880 – 1968) was an American author, disability rights advocate, a suffragist, a pacifist an activist and lecturer. She was only 19 months when an illness left her blind and deaf. She then communicated primarily using home signs until the age of seven, when she met her first teacher and life-long companion Anne Sullivan. Sullivan taught Keller language, including reading and writing. After an education at both specialist and mainstream schools, Keller attended Radcliffe College of Harvard University and became the first deafblind person in the United States to earn a Bachelor of Arts degree. Keller became a world-famous speaker and author. She was an advocate for people with disabilities. She traveled to twenty-five different countries giving motivational speeches about Deaf people's conditions.
