The Patent is a privilege granted by the State to the inventor in recognition of the investment and efforts made by him to achieve a technical solution that provides benefits to humanity. This privilege consists of the right to exclusively exploit the invention for a certain period of time.

Benefits

Being the only one who can exploit the invention for 20 years. Exploitation may consist of exclusively and directly marketing the patented product, or through third parties granting licenses, or transferring the rights obtained through its sale so that a third party can exploit the invention. In conclusion, the benefit is economic for the inventor or patent holder.

Regulatory Standard

The current legislation on patents is contained in Decision 486 of 2000 of the Andean Community Commission, a standard applicable to all member countries of the Andean Community. Likewise, this Decision is regulated in the regulatory decrees, and additionally, the SIC issues the Sole Circular that contains the set of guidelines that guide users on how industrial property procedures should be carried out. Illu strative Example

The first patent from the Microbiota Research Group of the University of Santander consists of an antibacterial gel for cosmetic and dermatological use that works to eliminate bacteria and treat dermatitis and wounds.
