Definition
Is the art and science of creating products that are not only visually appealing, but also functional and practical for mass production. It requires thinking about how to make things look good, but also how to make them feel, how to use them and how to produce them on a large scale. Industrial designers consider factors such as ergonomics, aesthetics, sustainability, manufacturing efficiency and durability to create products that meet the needs and aspirations of people in everyday life.

Protecting intellectual property
In Colombia, the Superintendency of Industry and Commerce (SIC) is responsible for managing the process of registering industrial designs. Its main tasks are to evaluate applications for industrial design registration, grant the corresponding registrations and mediate in disputes relating to intellectual and commercial property rights.
One company has developed a new kind of water bottle with a unique ergonomic shape and decorative embossing. The company can protect its intellectual property rights in this design by registering it with the relevant office. Registration gives the company the exclusive right to manufacture, sell or distribute the design for a specified period of time and prevents others from copying or imitating the design without permission.

If it passes the formal examination, the application is published in the Industrial Property Gazette for 30 working days for possible oppositions.
The SIC decides to grant or deny the registration of the design, considering novelty and other grounds. If granted, protection is obtained for 10 years from filing.
It is done at the Superintendence of Industry and Commerce (SIC) or virtually through SIPI.

Appeals
Interested third parties may oppose the application during the publication period. The applicant has 30 days to respond to the opposition.
The SIC reviews the documents and drawings submitted in the first 15 days. If there are any errors, the applicant is requested to correct them.
The applicant may file an appeal for reconsideration and appeal if the application is denied.

Yes, there is a fee to register an industrial design in Colombia. The amount may change depending on several aspects, such as the complexity of the design and the way the application is filed (either electronically or physically).
