Unit 2

Prohibition of Political Dynasty According to the 1987 Constitution

Since its ratification, our constitution states that political dynasties are prohibited, but no law has been passed to implement this constitutional provision. 1987 Constitution of the Philippines, Article II, Section 26: “The State shall guarantee equal access to opportunities for public service, and prohibit political dynasties as may be defined by law.”

No. 2649, during the 15th Congress of the Philippines. Explanatory Note: No. 2649, during the 15th Congress of the Philippines. Explanatory Note: The provision suggests leveling the political arena for all, addressing socio-economic and political inequalities in Philippine society, which often lead voters to elect relatives of ruling families due to convenience and cultural mindset.

Declaration of Policy: It is hereby declared the policy of the State to guarantee equal access and opportunity to public office and public service. "Second Civil Degree of Consanguinity or Affinity” - shall refer to the relatives of a person who may be the latter's brother or sister, whether of full or half-blood, direct ascendant or Persons Covered; Prohibited Candidates: (…) In all cases, no person within the prohibited civil degree of relationship to the incumbent shall immediately succeed to the position of the latter. Effect of Violation of Prohibition: The COMELEC shall motu proprio or upon a verified petition of any interested party deny due course to any certificate of candidacy filed in violation of this Act.

HISTORY/BACKGROUND OF THE ISSUE

Limitation on the Terms of Office of Elected Officials

  • President: 6-year term with no re-election
  • Senator: 6-year tenure per term with a maximum of 2 consecutive terms, for a total of 12 years
  • Congressman, Governor, Mayor, and all other local officials: 3-year tenure per term with a maximum of 3 consecutive terms, for a total of 9 years
Effects of Political Dynasties

Pablo Querubin's 2013 research found that despite the Constitution's limitations on elected officials' terms, political power remains in affluent families due to their frequent positions or appointments. This popularity boosts their chances of winning elections. The 11th Congress of the Philippines introduced the Party-List System Act to provide representation for marginalized groups and sectors in Congress.

- Although many political dynasties hinder the country’s development, some of them have good intentions and bring positive change to cities and provinces. They launch successful projects which motivate entrepreneurs to invest in businesses.

HISTORY/BACKGROUND OF THE ISSUE

Effects of Political Dynasties

- Political dynasties often profit from their government positions, passing on wealth to family members and accumulating wealth from public funds. This practice allows them to fund personal wants and needs, rather than genuinely helping the community and country.

Movements Against Political Dynasties

HISTORY/BACKGROUND OF THE ISSUE

Movements Against Political Dynasties

  • A group of former Vice President and Senator Teofisto Guingona and Dante Jimenez of Volunteers Against Crime and Corruption filed a petition to the Supreme Court in 2012, urging Congress to pass laws prohibiting political dynasties. They argued that Congress has failed to pass such legislation for 25 years.
  • Advocates for the National Interest, consisting of retired government officials and ex-AFP and PNP officials, called on the Philippine government to outlaw political dynasties and remove them in time for the 2025 local and national elections.

STATISTICS/DATA

3. STATISTICS / DATA

PHILIPPINES

STATISTICS/DATA

Political dynasties are prevalent in over 144 countries, including the Philippines. In America, 700 families with two or more members serving in Congress make up 1,700 of the 10,000 elected officials since 1774. In Europe, 13% of presidents and prime ministers between 2000 and 2017 came from political families, and 6 out of 24 leaders had ties to a previous president or prime minister. This demonstrates that coming from the right family can significantly enhance one's chances of entering politics.

Evidence/Example

An example of FAT political dynasty is the Marcos Family. Given the history of this family being involved in politics, their name is still frequently seen in government positions. Starts with Ferdinand "Bongbong" Marcos Jr. as the president alongside his son, Sandro Marcos as the congressman of the 1st district at Ilocos Norte. President Marcos's sister, Irene Marcos as a senator who also has a son, Matthew Marcos Manotoc as Ilocos Norte's Congressman. The Marcos siblings have extended family who also runs in the government like the Romualdez family.

FACES OF POLITICAL DYNASTY

The Marcos Family (1965 - present time)

  • Despite the dismal history, Marcos' supporters assert that it was a period of progress in the Philippines.
  • Bongbong's campaign capitalized on this sentiment, which helped him win the presidency and restore the Marcos family's political supremacy in the Philippines, extending beyond their district in Ilocos Norte.

FACES OF POLITICAL DYNASTY

The Aquino Family (2010-2016)

  • Benigno Simeon 'Noynoy' Aquino III, the 15th president of the Philippines, was born into politics due to his parents' legacy.
  • His father, Benigno Aquino Jr. was an opposition leader during Marcos' dictatorship. His assassination in 1983 led to the People Power Revolution. His mother, Corazon Aquino, became the first female president in 1986.

FACES OF POLITICAL DYNASTY

The Duterte Family (2016-present)

  • Members of the Duterte family are also active in politics. Duterte's daughter, Sara Duterte-Carpio, is the current vice president of the Philippines and was Bongbong Marcos Jr.'s running mate during the 2022 election.
  • (Durterte’s sons, Sebastian and Paulo, both secured local positions.)
  • Sebastian - current mayor of Davao City
  • Paolo - representative for Davao's first congressional district.

ON FAMILIES

implications on political dynasties

ON COUNTRIES

Political dynasties in the Philippines offer stability, local knowledge, and networks, but also power concentration in a few families, potentially leading to corruption and exacerbated social and economic inequality. Debates and reforms, including anti-dynasty laws, aim to balance these concerns and strengthen democracy in the country.

>

POSITIVE EFFECTS

1. Continuity and stability in governance: Political dynasties can provide a sense of stability and continuity in governance, which can be beneficial for the people. 2. Delivery of public goods and services: Political dynasties can facilitate the delivery of public goods and services to their constituents, improving the overall well-being of the people.

>

negative effects

1. Patronage politics and corruption: Political dynasties can lead to patronage politics, where politicians use their power to benefit their family and friends. 2. Abuse of power: Political dynasties can result in the abuse of power, as politicians may use their influence to enrich themselves and their families, rather than serving the best interests of their constituents.

Other movements against political dynasties include: Ang Kapatiran Party (Alliance for the Common Good), Aksyong Kabayanihan Para sa Organisadong Pagbabago (ANGKOP), Dilaab Foundation, Green Team Pilipinas International, Inc., Krusada Kontra Dynasty, Juana Change Movement, Movement Against Political Dynasties, Inc. (MAD), MAD-Crusade Against Dynasty and Corruption, Partido Lakas ng Masa, St. Thomas More Society, Inc. Law Center, Solidarity Movement Philippines, and Anti Political Dynasty Movement (ANDAYAMO). Until now, the Congress has not passed a law to clarify the true meaning of a political dynasty as prohibited by the Constitution.
