La période de la Révolution est une ère de changements. Le saccage des églises, des prêtres et la condamnation à mort de Louis XVI marquent une première rupture, renforcée par la Constitution civile du clergé de 1790 qui nationalise les biens de l'Église qui reviennent donc à l'État. La monarchie du droit divin qui faisait du catholicisme la religion d’Etat est abolie en 1789, c’est la 1ère étape de laïcisation en France permettant la liberté religieuse, qui est amenée par la Déclaration des Droits de l'Homme et du Citoyen. En 1801, année qui marque le début du Concordat, le mariage civil est créé,
indépendamment et antinomiquement au mariage religieux. Un combat commence alors entre l’État républicain et l’Église catholique quant à la place de la laïcité en France. De 1879 à 1905, grâce au mouvement instauré par Jules Ferry, ministre de l’instruction publique, qui rend l'éducation obligatoire et l'enseignement public laïc, ainsi que par la laïcisation du personnel enseignant par la loi Goblet de 1886, une seconde étape est franchie par la France. Il en est de même pour la médecine qui devient une institution d'État et s'émancipe de l'influence de l'Église. De plus, l’éducation morale et religieuse est remplacée en 1882 par l'éducation morale et civique telle que nous la connaissons aujourd'hui. Cependant, la religion garde une place importante dans la société et la culture française.
Le principe de laïcité est renforcé par la loi de séparation de l' Église et de l'État de 1905 qui stipule que « la République assure la liberté de conscience et met fin au Concordat. Elle garantit le libre exercice des cultes ». De plus, elle « ne reconnaît, ne salarie ni ne subventionne aucun culte ». Cette loi est l’un des piliers de notre société laïque actuelle et une avancée majeure pour le pluralisme religieux et la liberté de conscience. En 1958, le principe de laïcité a été inscrit dans la Constitution. A la suite d’une demande du Président Jacques Chirac quant à l’application du principe de laïcité dans la République, la loi du code de l’éducation voit le jour le 15 mars 2004 : « dans les écoles, les collèges et les lycées publics, le port de signes ou tenues par lesquels les élèves manifestent une appartenance religieuse est interdit. » Depuis, en 2007 et en 2021, des lois sont votées afin de permettre le respect du principe de laïcité notamment dans les services publics. La loi de 1905 n’a jamais été modifiée car elle permet une stabilité et des réponses aux questions qui voient le jour depuis.
La laïcité est un principe républicain fondamental. Elle a été affirmée dès la Révolution française et inscrite dans la constitution, notamment dans l’article 10 de la Déclaration des Droits de l’Homme et du Citoyen du 26 août 1789, qui stipule que « nul ne doit être inquiété pour ses opinions, même religieuses, pourvu que leur manifestation ne trouble pas l’ordre public établi par loi. ». Elle garantit donc la liberté de conscience, l’égalité de tous les citoyens quelle que soit leur croyance, la neutralité de l’État à l’égard des religions et le libre exercice des cultes. Quelles sont les différentes étapes du fondement de la laïcité telle que nous la connaissons aujourd’hui au cours de l’Histoire ? Avant 1789, l'Église est omniprésente dans la société française. Le compromis entre le pouvoir royal et le pouvoir religieux lors de la mort de Charlemagne en 814 installe une période féodale : le seul pouvoir en place est l’Église. Jusqu’à la Révolution, il n’existe pas de diversité religieuse autorisée. La France est une monarchie de droit divin : la symbolique religieuse est très forte dans le quotidien.

Mais quel est le but d’instaurer une laïcité stricte à l’école ? Afin de protéger les élèves contre le prosélytisme, les pressions et les discriminations, et de favoriser la liberté d'expression ainsi qu'une culture commune et partagée. Cela se traduit par une stricte neutralité du personnel et des élèves, avec une interdiction des signes et des tenues manifestant ostensiblement une appartenance religieuse. De plus, il est obligatoire d'assister à tous les cours, la religion ne peut pas servir d’excuse, sauf cas exceptionnel comme c’est le cas pour d’importantes fêtes. D’autre part, les cantines scolaires sont encouragées à proposer des menus différenciés et variés.En outre, la sensibilisation des élèves est promue à travers des cours éducatifs tels que l'Éducation Morale et Civique (EMC).Pour des informations plus détaillées, vous pouvez consulter le vademecum "La laïcité à l’école", qui présente une série de fiches pratiques sur les différentes applications du principe de laïcité à l’école. 2/ La laïcité à l’école : source de conflits A) menaces envers l’équipe pédagogiques Cependant, depuis quelque temps, on observe une tendance à la violence de la part des élèves envers les professeurs. En exerçant leurs métiers, ils s’exposent à des menaces et des agressions physiques. Le corps enseignant s’est déjà vu perdre un collègue. Le 16 Octobre 2020, Samuel Paty, un professeur d’histoire-géographie, a été décapité pour avoir présenté une caricature du prophète Mahomet, durant un cours sur la liberté de la presse. C’est sur les réseaux sociaux que cette affaire a pris des proportions virales, des commentaires suscitant la haine ayant été publiés à son égard. Malheureusement, le cas de Samuel Paty n'est pas isolé. En effet, en 2023, Dominique Bernard fut assassiné dans des circonstances semblables. Ainsi, les attentats terroristes auxquels les établissements sont confrontés sont loin d’être anecdotiques. De manière générale, la fréquence des menaces verbales et physiques ont amplifiée ces dernières années.
D’après les chiffres donnés par le gouvernement français, 74% de la population considère la laïcité comme étant un droit fondamental. Néanmoins, la façon dont la laïcité est appliquée dans l’Education Nationale divise les Français. En effet, environ une moitié estime qu’elle est bien exercée tandis que l’autre pense le contraire, selon l’étude d’opinion réalisée par Viavoice pour l’Observatoire de la laïcité en janvier 2020.Mais aujourd'hui, la question de la laïcité à l'école est polémique et les derniers faits d'actualité mènent à se demander si la laïcité à l'école est mise en danger.
