INTRODUCTION
We understand that the Constitution of the United States revolutionized in a great way, knowing that each of the nations has created their own constitutions, each of them has sovereignty which has its absolute power within its own borders and in some way there is a relationship between the Constitution and the U.S. Government, this presentation is based on knowing each one and how its development has been in its process.
What is the Constitution?
A constitution is the aggregate of fundamental principles or established precedents that constitute the legal basis of a polity, organization or other type of entity, and commonly determines how that entity is to be governed.
What is Government?
A government is the system or group of people governing an organized community, generally a state. Goverment normally consists of legislature,executive, and judiciary.
Consent of the Governed.
When we talk about governments we know that the majority did not care what citizens thought about the government's actions. It was exactly this situation that got America's
Founders were so steamed that they started a war in order to create their own government. Consent of the governed goes hand in hand
with popular sovereignty.
What is Constitutional Principles
Constitutional principles are the values that underlie constitutional democracy. These principles provide a framework within which policy is properly carried out.
Popular Sovereignty
Popular sovereignty may be the most fundamental idea behind America. “the States” have a say in almost everything. That may not sound like popular sovereignty at first, but it is. How? Article 4 guarantees that voters in each state will have the right to elect their own state governments, so the ultimate power of state governments… the people! That means even where the Constitution gives power to “the States,” it’s actually giving power to the people who elect the states’ governments.
Rule of Law
He principle that society it is governed by laws, not people. Article 6 establishes the Constitution as the “supreme law of the land” for the United States. Article 2 requires the president to take an oath promising to “preserve, protect and defend the Constitution of the United States.”
Separation of Power
Refers to the division of a state's government into "branches," each with separate and independent powers and responsibilities, so that the powers of one branch do not conflict with those of the other branches.
The Constitution separates power according to function. Article 1
creates the legislative branch, which has the lawmaking power.
Article 2 creates the executive branch, which is empowered to
carry out the laws the legislative branch makes.
Federal Law
Federal law is the body of laws created by the federal government of a country, such as the United States. The Constitution actually sets Congress up for this effort through the addition of the Necessary and Proper Clause. Here's an example: legislation like the civil rights and voting rights acts provided guidelines on how various protections in the Constitution should be accomplished.
Checks & Balances
which gives each branch the ability to restrain certain actions the other branches take. In the Constitution, this usually shows up as one branch’s actions requiring approval from another branch. Article 1 requires the president’s approval before a law passed by the legislative branch can actually go into effect. Between these failsafes and all the other principles, the Founders hoped their Constitution would protect Americans’ liberty for all future generations.
Judicial Review
It is a process under which the executive, legislative or administrative actions of a government are subject to review by the judicial branch. Article 3, the Founders set up a judicial branch with the power to hear certain types of federal cases. The judicial branch also has the power to interpret the Constitution.
Conclusion
the U.S Constitution we observe its main foundations which have been essential to know the government, thus we can mention what they are: definition of the Constitution, definition of Government, Popular Sovereignty, Rule of Law, Separation of Power, Federal Law, Checks and Balances, Judicial Review, each has its functions of which the Government is also aware, they must be fulfilled.
