1st DUI vs. 2nd DUI: What Are The Consequences

If you are facing a DUI charge, you may wonder what the consequences are for a first offense and how those penalties compare to a second offense. Here's a look at the differences between a first and second DUI charge: 1st DUI If convicted of a DUI for the first time, penalties may include the following:

  • Less than 10 days in jail
  • Minimum of $250
  • Community service
  • Additional charges and fees
  • Installation of an interlocking ignition device
  • A DUI misdemeanor charge on your record
2nd DUI A second offense of DUI in Arizona is subject to stiffer penalties than a first-offense DUI. If you receive two DUI convictions within seven years, you could face consequences such as:
  • A minimum of 90 days in jail.
  • A minimum of 120 days for a BAC between .15 and .199
  • A minimum of 180 days in jail for a BAC above .2
  • A minimum of $500 in fines and up to $2500 in fines, plus additional surcharges
  • A higher number of community service hours
  • Revocation of your license for one year
  • Installation of an ignition interlock device once driving privileges are restored
  • Drug/alcohol evaluations and DUI treatment
  • A second DUI misdemeanor charge on your record
The consequences above apply to DUI cases that are not considered "extreme DUI" or "super extreme DUI." The distinction between a regular DUI and an extreme or super extreme DUI is based on blood alcohol concentration (BAC). If the BAC is 0.15%, the individual will be charged with an extreme DUI. If higher than 0.20%, the individual will be charged with a super extreme DUI, and the punishment for multiple convictions under such circumstances will be more severe.
