Although compliance with 28 CFR Part 23 is not mandatory for all agencies, there are benefits to applying the regulation to your organization.

Complying with 28 CFR Part 23 as a part of your policy efforts:
Sets a national standard for all law enforcement agencies
Provides transparency and public trust
Establishes training standards
Provides for adequate oversight and supervision

Using 28 CFR Part 23 aids in building a standardized national criminal intelligence information sharing architecture. The National Criminal Intelligence Sharing Plan (NCISP) recommends use of the regulation regardless of whether the criminal intelligence system is subject to the regulation. This ensures that the submission/collection, use, access, storage, and dissemination of criminal intelligence information by intelligence projects and member or participating law enforcement and homeland security agencies conform to sound practices that protect the privacy and constitutional rights of individuals and organizations.4
Using the regulation as a guide in the policy development process enables your agency to codify and communicate efforts to strike the balance between the legitimate needs of law enforcement and the protection of P/CRCL.
