Hans Kelsen ( Praga, 11 de Octubre de 1881- Berkeley, California, 19 de abril de 1973) fue un jurista y filósofico austriaco de origen judio. Él definio este sistema como la forma en que se relacionan un conjunto de normas juridicas y la principal forma de relacion entre estas dentro de un sistema, es sobre la base del principio de jerarquia.
