my inspiration
human rights
- The Right to protest is protected under the European Convention of Human Rights and adopted domestically under the Human Rights Act 1998.
- Article 10 - The Right to Freedom of Expression
- Article 11 - Freedom of peaceful assembly and the freedom of association with others
- Qualified Right which may be limited for a legitimate aim
the current law
- the public order act 1986- has provisions to limit or prohibit protest if there are concerns of saftey or disruption eg. EDL protest restrictions
- 'reasonable belief' 'reasonable force'absolutely necessary'
- against breach of peace, threatening or abusive words or behaviour
- harrassment act 1997 - preventing protest at peoples homes or work
- serious organised crime and police act 2005
- terrorism act 2000 s60 -violates article 8
- kettling/containment-article 5
the significance of 2009
reform
- police, crime, sentencing and courts bill (pcsc bill) - Priti patel
- the bill would : lower the legal test that police have to meet to set conditions on protests
- widening the types of conditions police can issue on protest
- allowing the police to issue one person conditions
- amending the offence of failing to comply with conditions
methodology
useful resources! - briefing papers -legislation - college of policing -articles -human rights cases comparingly domestic cases.
- Practical in analysing the legal doctrine -A constant stream of case law comparison the evaluation of the law with real-time protests taking place currently. -This allows to highlight the ambiguity and ineffectiveness of areas of the law. -Although it can deviate from social facors and what the law looks like in reality
reflection
- methodology - socio-legal approach
- difficulties remaining focused
- procrastination
- understood how useful the marking criteria is when stuck or losing focus
if i was to do it again...
Bias : Coming into the project with a preconception of the police solution: my research
Utilising Resources: paying more attention to moodle solution: using all my resources availiable
Time Management : not only with this module but as a whole solution: a planner with mini achievements are rewarded
