Political system

  • first free election in 1994
  • result is a constitution and a parliamentary system of government
  • final constitution was adopted in 1996 and has been in force since February 1997.
  • federal elements since the 1996 constitution
  • comparable to the German system
  • federalism, a state is made up of sub-states
  • political system is made up of three powers

Executive

  • executive power is made up of the president and his cabinet
  • head of state and head of government
  • nominates and fires the ministers
  • elected every five years by the National Assembly

Judicial

  • constitutional court is the highest authority in constitutional matters
  • supreme court the highest court for all other issues
  • most hearings in the local courts
  • constitution guarantees citizens
  • right to a fair, public hearing
  • reasonable period of time for reaching a decision
  • right to appeal
  • judicial power must also be neutral and independent

Legislative

  • two-chambers-parliament
  • national assembly with 400 members elected by the people
  • national council of provinces with ten delegates from each of the nine provinces
  • national constitution elects and partly forms the government
  • mostly the leader of the strongest fraction holds the position of President of the Republic.
  • legislative period goes five years
